One, printed to indicate a use as container for “Balti Tandoori Chicken Marsala & Naan”, measures 7 7/8” x 7” x 2 ½”. The other, printed to indicate a use as container for “Sponge Cake with Real Dairy Cream”, measures 5 ¾” x 5 ¾” x 2 ¼”.

Cargo Service Building No. 80 JFK International Airport Jamaica, N.Y. 11430 RE: The tariff classification of folding cartons from Great Britain Dear Mr. Del Pozo: In your letter dated February 23, 2001, on behalf of your client, Print Design Graphics, which is located in the United Kingdom, you requested a tariff classification ruling. Samples were submitted, which will be retained for reference. You refer to them as “packaging material, printed by a lithographic process”, to be imported through various ports by different importers. The samples are folding cartons of non-corrugated paper or paperboard. They are presented folded, flat, and will presumably be imported in this condition. When assembled, or “set up”, they form boxes for the packaging and marketing of foods. One, printed to indicate a use as container for “Balti Tandoori Chicken Marsala & Naan”, measures 7 7/8” x 7” x 2 ½”. The other, printed to indicate a use as container for “Sponge Cake with Real Dairy Cream”, measures 5 ¾” x 5 ¾” x 2 ¼”. The applicable subheading for articles like the samples is 4819.20.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for: Folding cartons, boxes or cases of non-corrugated paper or paperboard: Other (than sanitary food and beverage containers). The General rate of duty would be 0.8 percent ad valorem. However, articles, the product of the United Kingdom, which are folding cartons, boxes or cases of non-corrugated paper or paperboard (provided for in subheading 4819.20) are presently dutiable in subheading 9903.08.10, HTS, at the rate of 100 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
