Inc. 1600 Genessee, Suite 450 Kansas City, MO 64102 RE: The tariff classification of a men’s shirt from Korea Dear Ms. Bounds: In your letter dated March 12, 2001, you requested a classification ruling on behalf of Design Resources, Inc. A sample of the garment, identified as style 8096, was submitted and will be returned. The garment is a men’s shirt which is stated to be made of 70 percent polynosic (rayon) and 30 percent polyester woven fabric. The garment features a button down collar, a full frontal opening secured by seven buttons, long sleeves with placketed, buttoned cuffs, a breast pocket, a pleated back and a curved hemmed bottom. The label in the shirt collar indicates size “L”. The applicable subheading for style 8096 will be 6205.30.2070, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ shirts, of man-made fibers, other, other, other, other, men’s. The duty rate will be 29.6 cents/kg plus 26.4 percent ad valorem. Style 8096 falls within textile category designation 640. Based upon international textile trade agreements products of Korea are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
