Dear Ms. Rodriguez: In your letter dated January 4, 2001, you requested a ruling on tariff classification. The sample you provided is a brass door hinge, 4 inches in length [10.2 cm.] Although your letter describes it both as a brass door hinge and as a steel cabinet hinge, the actual sample is a brass door hinge. Furthermore, your letter indicates that you believe that Hong Kong/China is eligible for a free rate of duty under the Generalized System of Preferences. This is not the case. The applicable subheading for this product will be 8302.10.9030, Harmonized Tariff Schedule of the United States (HTS), which provides for base metal mountings, fittings and similar articles suitable for furniture, doors, staircases, windows, blinds, coachwork, saddlery, trunks, chests, caskets or the like, hinges, other, suitable for interior and exterior doors. The rate of duty will be 3.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R.177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
