The subject product, referred to as “Heath & Heather Organic Echinacea Tea,” consists of echinacea herbal tea put up in sachets. The sachets, in turn, are put up for retail sale in a cellophane-sealed paperboard box containing twenty sachets. According to the package label, “100% Organically grown Echinacea” (Echinacea purpurea) constitutes the sole ingredient. The rate of duty will be free. This merchandise may be subject to the requirements of the Federal Food, Drug, and Cosmetic Act, which is administered by the U.S. Food and Drug Administration.
