Dear Mr. Qualley: In your letter dated November 15th, which was received November 28th, 2000, you requested a classification ruling. The supplier is N.V. Vetex, Belgium. The instant sample, as described in your correspondence, and identified as a “trilaminate”, consists of a thin center layer of milky white, polyurethane plastics breathable membrane or film which has been laminated between two layers of polyester man-made fiber tricot knit fabric which are green in color. This thin, PU film, is visible in cross section and is stated to weigh 50 g/m² +/-5%. The tricot knit portion (both sides) accounts for 110-190 g/m² +/-5%. You state that the total weight of this material, as imported, will range from 160-240 g/m² +/-5% and will be brought in to the United States as roll goods measuring from 142 cm to 225 cm in width and 70 yards in length. The applicable subheading for the material will be 5903.20.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics impregnated, coated, covered or laminated, with plastics, with polyurethane, of man-made fibers, not over 70 percent by weight of rubber or plastics. The duty rate will be 7.9 percent ad valorem. Effective January 1, 2001, the duty rate will be 7.8 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
