Dear Mr. Kelly: In your letter dated November 16, 2000, on behalf of Jones Apparel Group USA, Inc., you requested a tariff classification ruling. Style number G51541808 is a women’s 76% silk, 24% polyester knit sleeveless pullover. The garment extends from the shoulders to the hip area. It features a square neck with capping around the neckline and around the armholes, and a straight self finished bottom. The applicable subheading for the pullover will be 6110.90.1060, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: Of other textile materials: Containing 70 percent or more by weight of silk or silk waste: Other: Women’s or girls’. The rate of duty will be 2.9 percent ad valorem. The pullover falls within textile category designation 739. This merchandise is not subject to quota or the requirements of a visa. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
