Dear Mr. Oliu: In your letter dated November 3, 2000, you requested a classification ruling. You submitted a roll of fiberglass mesh tape, which you state is composed of 35% glue and 65% fiberglass; you break down the 65% fiberglass as follows: SIO2 : 43.6% MGO : 2.7 AL2O3 : 4.0 R2O : 7.8 CAO : 6.2 Other : 0.7 In a telephone conversation with National Import Specialist Mitchel Bayer, you stated that the tape is made of rovings. You state that the tape is used in construction to cover joints of gypsum board (sheetrock). The applicable subheading for the fiberglass tape will be 7019.40.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Glass fibers . . . and articles thereof . . .: Woven fabrics of rovings: Of a width not exceeding 30cm: . . . Other.” The duty rate for the years 2000 and 2001 will be six percent ad valorem. Subheading 7019.40.1500, HTS, falls within textile category designation 622. You have not stated the country of origin of the merchandise, but based upon international textile trade agreements products of many countries are subject to quota and the requirement of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, including which countries are subject to these requirements, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
