Dear Mr. Sanders: In your letter dated August 29, 2000, on behalf of Allfoam Industries Ltd., you requested a tariff classification ruling. Diagrams of five foam pads were provided with your letter. The pads are manufactured in Canada from foam blocks made in the United Kingdom. The pads, which are composed of ethylene vinyl acetate (EVA), are cut to size and shape in Canada where Velcro tabs made in the United States are added. The pads will be used in the manufacture of sleeping bags. The applicable subheading for the foam pads will be 3926.90.9880, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of plastics, other. The general rate of duty will be 5.3 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
