Dear Mr. Dominguez: In your letter dated April 10, 2000, you requested a tariff classification ruling. The submitted sample, vendor stock #11860, is an “Aqua-Air CD Tower.” The item is a compact disc storage tower made of plastic. It includes a built-in electrical apparatus in the base for creating reflective patterns on water, which is pumped into plastic cylinders attached to both sides of the tower. The CD tower is designed to stand on the floor. We regret that the sample cannot be returned to you as requested as it was received in a damaged condition. The applicable subheading for Aqua-Air CD Tower will be 9403.70.8010, Harmonized Tariff Schedule of the United States (HTS), which provides for other furniture and parts thereof: furniture of plastics: other: household. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
