Lynch Sullivan & Lynch, P.C. 156 State Street Boston, MA 02109-2508 RE: The tariff classification of a woman’s vest from China Dear Mr. Lynch: In your letter dated July 13, 2000, you requested a classification ruling on behalf of Susan Bristol Inc. The sample submitted with your request will be returned to you under separate cover. Style 1053911 is a woman’s woven vest constructed from 100 percent silk woven fabric that is embellished with embroidery. The vest contains lightweight polyester batting between the inner and outer silk shells. The garment features oversized armholes, a stand up collar, side vents and a full front opening secured by five buttons. The applicable subheading for style 1053911 will be 6211.49.1070, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of other textile materials: containing 70 percent or more by weight of silk or silk waste: vests. The duty rate will be 3.8 percent ad valorem. Style 1053911 falls within textile category designation 759. Based upon international textile trade agreements products of China are currently not subject to quota restraints or a visa requirement.
