The DOC has also determined that candles designed only for use in connection with a holiday or special event are not within the scope of the antidumping duty order. In our opinion, Item #8579A, Small Ghost Candle, Item #8579B, Large White Ghost Candle, and Item #8586, Floating Ghost, are not within the scope of the antidumping duty order on petroleum wax candles from China.

Dear Ms. Petrus: In your letter dated May 17, 2000, on behalf of Bath & Body Works, you request a tariff classification ruling. You submit the following samples: Item #8579A, Small Ghost Candle, is a white colored scented candle molded in the shape of a ghost that measures approximately 3" in height and 3" in diameter and is holding an orange colored wax bag with the words "Trick Or Treat." Item #8579B, Large White Ghost Candle, is a white colored scented candle molded in the shape of a ghost that measures approximately 5" in height and 3" in diameter and is holding an orange colored wax bag with the words "Trick Or Treat."
