Dear Mr. Paul Vroman: In your letter dated May 22nd, 2000, on behalf of Steven Gellis Sports Inc., you requested a tariff classification ruling. The sample submitted with your request is identified as style #RSR1115. The item is an inflatable rucksack/backpack, which can also be used as a cushion. The useful function as a pack is greater than the function as a cushion. The bag will be used to carry small personal effects commonly found in a handbag. The interior consists of a lined, single compartment with no additional features. A zippered closure and a front flap with a tuck lock closure secure the top opening of the bag. The applicable subheading for #RSR1115 will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTS), which provides for handbags, whether or not with shoulder strap…with outer surface of sheeting of plastic. The rate of duty will be 17.6% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
