You submitted a sample as well as a picture of a motor vehicle Track Bar Bracket, comprised of two pieces of stamped steel, used in the Jeep Grand Cherokee which is of unibody construction. Sample Part Number 55136317 is the Track Bar Inner Bracket and Sample Part Number 55136319 is the Track Bar Outer Bracket. You state that these two separate pieces when assembled to the front rail (or sill) actually form a single bracket. Both portions of the bracket are welded to the rail. Also below the rail, where both portions of the bracket mate to each other, they are welded together which essentially forms a single functional unit. The bracket is the attachment point for the track bar (part of the suspension system), which is bolted to the bracket. The front rail assembly forms an integral part of the body structure of the vehicle which is of unibody construction. You suggest that both pieces of the track bar bracket be properly classified HTSUS 8302.30.3060 as "Other mountings, fittings and similar articles suitable for motor vehicles; and parts thereof: Other." The applicable subheading for the Track Bar Brackets will be 8302.30.3060, Harmonized Tariff Schedule of the United States (HTS), which provides for Base metal mountings, fittings and similar articles suitable for furniture,…coachwork...; and base metal parts thereof: Other mountings, fittings and similar articles suitable for motor vehicles; and parts thereof: Of iron or steel, of aluminum or zinc…Other. The rate of duty will be 2% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
