Dear Ms. Thobe: In your letter dated March 23, 2000, you requested a tariff classification ruling for a 12” long and 3” tall candleholder (Style 22332). The candleholder is sculpted to resemble a row of attached jack-o-lanterns. Each of the pumpkins has a painted jack-o-lantern face. Placing a candle inside any of the four pumpkins allows the illumination to show through the carved out faces. Each pumpkin is orange colored on the exterior and yellow in the interior. The candleholder is 100% ceramic The merchandise will clear in the port of Columbus, Ohio. Your sample is being returned under separate cover. The applicable subheading for the jack-o-lantern candleholder will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for ?Festive, carnival or other entertainment articles....Other: Other.? The rate of duty will be free. This ruling is being issued under the provisions of Section 177 of the Customs Regulations (19 C.F.R. 177).
