Dear Ms. Hodur: In your letter dated March 17, 2000, you requested a tariff classification ruling on behalf of CK Jeans. As requested, the sample will be returned. Style CM5VU6244 is a men's garment constructed from 70 percent linen, 30 percent rayon, knit fabric that measures 12 stitches per 2 centimeters counted in the horizontal direction. Style CM5VU6244 features a partial front opening with two button closures; a rib knit spread collar; short sleeves with rib knit cuffs; and a staight, hemmed bottom. The applicable subheading for Style CM5VU6244 will be 6110.90.9088, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of other textile materials: other: other: other: other: men's or boys'. The duty rate will be 6 percent ad valorem. Style CM5VU6244 falls within textile category designation 838. Based upon international textile trade agreements, products of Hong Kong are subject to visa requirements and quota restraints.
