Dear Ms. Horner: In your letter dated March 16, 2000, you requested a tariff classification ruling. Style number 05103138 is a women’s 100% cotton jersey knit dress. The dress extends from the neck to just above the ankles. It features a scoop neck with a satin trimmed placket with three satin covered buttons, long sleeves with satin trim at the cuffs, side vents, which extend from the knees to the bottom of the dress. The dress has a straight hemmed bottom. Your sample is returned as requested. The applicable subheading for the dress will be 6104.42.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for dresses: Of cotton: Women’s. The rate of duty will be 11.8 percent ad valorem. The dress falls within textile category designation 336. Based upon international textile trade agreements, products of Korea are subject to quota and the requirements of a visa. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available on the Customs Web Site at WWW.CUSTOMS.GOV. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
