Dear Mr. Rodriguez: In your letter dated February 21, 2000, you requested a tariff classification ruling. The ruling was requested on a “BBQ Bamboo Skewer Set” identified as Item #W-50-A-1345. An information sheet accompanying your inquiry shows that the set consists of 100 pieces of ten-inch-long bamboo skewers packed in a plastic bag with a printed header card. The applicable subheading for the skewer set will be 4421.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of wood…skewers, candy sticks, ice cream sticks, tongue depressors, drink mixers and similar small wares. The rate of duty will be 5.1%. Importation of this merchandise may be subject to regulations administered by the U.S. Food and Drug Administration. Inquiries may be directed to that agency at 5600 Fishers Lane, Rockville, MD 20857. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
