Dear Ms. Kim: In your letter dated November 22, 1999 you requested a classification ruling. The sample will be returned to you as requested. The submitted sample, Style #2B 4141 KC, identified as Jean Kelly is a men’s jacket composed of woven 63% polyester/37% cotton fabric coated with PVC that completely obscures the underlying fabric. The jacket is hip length and features a full front zippered closure, two slash pockets, two flap breast pockets with a hook and loop closure, pointed collar and adjustable cuffs with hook and loop closure. The applicable subheading for Style 2B 414 KC will be 6210.40.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Garments, made up of fabrics of heading 5602, 5603, 5903, 5906 or 5907: Other garments, of the type described in subheadings 6202.11 to 6202.19: Other men’s or boys’ garments: Having an outer surface impregnated, coated, covered or laminated with rubber or plastics material which completely obscures the underlying fabric.” The duty rate will be 5.7% ad valorem for 1999 and 5.3% for the year 2000. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
