Dear Mr. Navedo: In your letter dated October 15, 1999, on behalf of your client Multipet International Inc., you requested a classification ruling. The submitted sample is identified as “Wiggly Giggly Ball”, item #57506. Your letter of inquiry states that this ball comes in two sizes, large and small. You also state that this ball does not bounce and it is not a sports ball. This ball is made of durable plastic and it is suitable for pets. When the ball is shaken, it makes a noise. No batteries are required for this pet toy. The applicable subheading for both sizes of the “Wiggly Giggly” pet toys #57505 and #57506 will be 3924.90.5500 Harmonized Tariff Schedule of the United States (HTS), which provides for…other household articles…of plastics: other, other. The rate of duty will be 3.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
