Main Street Fredonia, NY 14063 RE: The tariff classification of a plastic bucket from Canada. Dear Ms. Corupe: In your letter dated October 8, 1999, and received in this office on October 19, 1999, you requested a classification ruling. The submitted literature depicts a product that is identified as item “Odjob” multimixer, item #9798000020. It is a plastic bucket and lid with baffles on the inside to make mixing easy and fast. This bucket measures 18” by 12” in diameter. The lid also doubles as a measuring device. The plastic bucket can be used to mix cement, mortar, grout, oil, seeds, fertilizer, compost or paint. This product can be used anywhere, it requires no power for operation. We believe the product will be primarily used around the home. Your letter of inquiry states that you believe this product would be classified in heading 8474. This heading does not apply, the multimixer is not a mechanical device and it is not machinery used for mixing. The applicable subheading for the plastic multimixer will be 3924.90.5500, Harmonized Tariff Schedule of the United States (HTS), which provides for…other household articles…of plastics: other, other. The rate of duty will be 3.4 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
