Dear Mr. Mlawski: In your letter dated September 17, 1999, on behalf of your client Merck & Co., Inc., you requested a tariff classification ruling for P-Nitrobenzyl-(2R,5R,6S)-6-((R )-1-Hydroxyethyl)-3,7-Dioxo-1-Azabicyclo(3.2.0)Heptane-2-Carboxylate which is used as a pharmaceutical intermediate in the synthesis of imipenim (antibiotic). The applicable subheading will be 2933.79.0900, Harmonized Tariff Schedule of the United States (HTS), which provides for heterocyclic compounds with nitrogen hetero-atom(s) only: aromatic lactams: other. Pursuant to General Note 13 to the Harmonized Tariff Schedule this product is free of duty. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
