The submitted sample, style 9439’99, is a woman’s upper body garment constructed from 96 percent cotton and 4 percent spandex woven fabric. The abbreviated garment features a full lining, a shaped neckline, one inch wide shoulder straps, a left side opening secured by five buttons and an elasticized back middle panel. The garment extends from the top of the bust to just above the waist. The applicable subheading for style 9439’99 will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: other. The duty rate will be 8.4 percent ad valorem. Style 9439’99 falls within textile category designation 359. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and a visa requirement. The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
