Dear Mr. Garrisi: In your letter dated August 5, 1999, you requested a tariff classification ruling. The product designated “Microtech Expanded Polyvinyl Chloride Pellets” was analyzed by the New York Customs Laboratory (Report 2-1999-30503 dated 10/12/99) and found to consist of plasticized polyvinyl chloride classifiable in subheading 3904.22.0000, Harmonized tariff Schedule of the United States (HTS), which provides for other polyvinyl chloride: plasticized, in primary form. The rate of duty is 8.3 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which is administered by the U.S. Environmental Protection Agency.
