Dear Ms. Costley: In your letter, dated July 12, 1999, you have requested a tariff classification ruling. The merchandise is described thus: Product A: "Ecrevisse Acadienne Crawfish Cakes." The ingredients are 45 percent crawfish meat, 17 percent cracker crumbs, 13.7 percent mayonnaise, 9 percent onions, 6 percent eggs, 4 percent peppers, 3.25 percent mustard, 1 percent garlic, 1 percent Cajun seasoning, and 0.05 percent lemon juice. During the manufacturing process crawfish is cleaned, cooked, cooled, and the meat is extracted. Then the meat is coarsely chopped and combined with cracker crumbs, mayonnaise, eggs, onions, mustard, Jalapeno peppers, lemon juice, and spices to create a dough. The dough mixture is formed into 3 ounce round cakes that are cooked (sauteed) and quick frozen. They are packed into master cartons, each containing 40 crawfish cakes. Product B: "Cajun Crawfish Popcorn." The ingredients are 46 percent crawfish meat, 38 percent breading, 15 percent batter, and 1 percent Cajun seasoning. Crawfish is cleaned, cooked, and the meat is extracted. Then the meat is marinated in a mixture of oil, lemon juice, cayenne pepper, garlic, onions, and salt. The meat is battered, breaded, deep fried, quick frozen, and packed in 10 ounce bags or 10 pound cases. The applicable subheading for cooked crawfish cakes and cooked crawfish popcorn will be 1605.40.1000, Harmonized Tariff Schedule of the United States (HTS), which provides for crustaceans, molluscs and other aquatic invertebrates, prepared or preserved, other crustaceans, other. The rate of duty will be free. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
