Dear Ms. Schneider: In your letter dated March 23,1999 you requested a tariff classification ruling on behalf of FCI (Tampa). The items in question are ball bearings. Samples and descriptive literature were submitted. The part number and outside diameter of the outer race of each of the samples is listed below. The rate of duty will be 9 percent ad valorem. The applicable subheading for the 6201-Z, 6201-RZ, 6202-Z, 6202-RZ, 6203-Z, 6203-RZ, 6204-Z, 6204-RZ 6205-Z, 6205-RZ and 6205-2RS-1 bearings will be 8482.10.5048, HTSUS, which provides for other single row, radial ball bearings, having an outside diameter over 30 mm, but not over 52 mm. The rate of duty will be 9 percent ad valorem. It is the opinion of this office that the bearings listed above are not subject to antidumping duties because ball bearings which originate from China are not within the scope of current orders of the Department of Commerce relating to antifriction bearings. Should you desire a binding ruling on the applicability of dumping orders to your merchandise, please write directly to the Department of Commerce, Office of Compliance, Washington, D.C. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
