Dear Mrs. Fair: In your letter dated March 24, 1999, you requested a tariff classification ruling. The sample submitted is a decorative candle holder, item number 88011, which measures approximately 3 1/2 inches high. It features a maple leaf-shaped polyresin holder which is designed to contain a globe-shaped glass candle holder. It is noted that the glass holder measures about 2 1/2 inches high with a open top diameter of 2 inches and a base diameter of 1 1/4 inches. The applicable subheading for this candle holder, item number 88011, will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings. The rate of duty will be 6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
