Dear Ms. Vinson: In your letter dated December 14, 1998 you requested a tariff classification ruling on behalf of your client Pierburg. The items in question are described as a track ring, part number 3.52791.00.0, a main impeller, part number 3.52792.01.0, an impeller, part number 3.52949.00.0, and two O-rings, part numbers 3.61044.00.0 and 3.56069.00.0. Samples and technical drawings were submitted. The articles in question are produced exclusively for use in a fuel pump. The fuel pump is identified as model E3SS and is designed to supply fuel to internal combustion piston engines. The track ring, main impeller, impeller and O-rings are all integral parts of the fuel pump. The O-ring identified as part number 3.61044.00.0 is made of nitrile butadiene rubber. The O-ring identified as part number 3.56069.00.0 is made of a plastic material. The rate of duty will be 2.5 percent ad valorem. The applicable subheading for the plastic O-ring will be 3926.90.4510, HTSUS, which provides for O-rings as other articles of plastics. The rate of duty will be 3.5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR 177).
