Dear Ms. Malina: In your letter dated January 19, 1999, you requested a classification ruling. As requested, the samples will be returned to you. You have submitted two samples. Style 54127 is a man's 100% nylon woven pullover. The long sleeved unlined garment features a rib-knit neckline, rib-knit cuffs and a rib-knit bottom. Style 54132 is a man's 100% nylon woven pullover vest. The sleeveless unlined garment features a rib-knit neckline, rib-knit edging on the armholes and a rib-knit bottom. The applicable subheading for style 54127, will be 6211.33.0040, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, men's or boys': of man-made fibers, shirts, excluded from heading 6205. The duty rate will be 16.5 percent ad valorem. The applicable subheading for style 54132, will be 6211.33.0054, Harmonized Tariff Schedule of the United States (HTS), which provides for track suits, ski-suits and swimwear; other garments: other garments, men's or boys': of man-made fibers, vests: other. The duty rate will be 16.5 percent ad valorem. Style 54127 falls within textile category designation 640. Style 54132 falls within textile category designation 659.
