Dear Mr. Terrell: In your letter dated November 30, 1998 you requested a tariff classification ruling on behalf of Design Resources Incorporated. The sample will be returned as requested. The sample, style 7502, consists of a jacket and pair of trousers which are both made of 100% nylon which is visibly coated with Hytrel. The jacket features long sleeves with velcro cuffs, a zippered frontal opening with a snapped storm flap, a hood which zips into the collar, numerous pockets and zippers at the side seams. The trousers have an elasticized waist, are fully lined, have patched pockets on the front and back and also have zippers at the ankles with velcro for additional tightening. The rate of duty will be 6.1%. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
