The first item, "glass pumpkin votive," will be addressed under a separate ruling (D82489). All other items, which are the subject of this ruling, were examined and will be returned to you as requested. Item #2 is an eight inch clear glass bowl with a three inch pedestal base. This item has glass hearts molded into the glass. You indicated in your letter that the country of origin for this item is Poland and the unit value is $3.72. The applicable subheading for the decorative glass bowl will be 7013.99.8000, HTS, which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes...: other glassware: other: other: other: valued over $3 but not over $5 each. The rate of duty will be 13.5 percent ad valorem. Item #3 is a tree-shaped clear glass dish measuring approximately nine and one half inches in length by six and one half inches in width. Three glass compartments are molded into the item. You indicated in your letter that the country of origin for this item is Turkey and the unit value is $4.41. The applicable subheading for the tree-shaped glass dish will be 7013.39.5000, HTS, which provides for glassware of kind used for table (other than drinking glasses) or kitchen purposes other than that of glass-ceramics: other: other: other: valued over $3 but not over $5 each. The rate of duty will be 15 percent ad valorem. Item #4 is a clear glass jar with a removable glass knob lid. This item has a lead crystal-like appearance and features a molded glass nutcracker motif. The jar measures approximately four inches in height by six inches in diameter. You indicated in your letter that the country of origin for this item is Germany and the unit value is $10.28. A 24 percent or greater lead monoxide content is required for items to be considered lead crystal. When there is a lead monoxide content of 24 percent or greater, the applicable subheading for the glass jar will be 7013.91.5000, HTS, which provides for glassware of a kind used for table, kitchen, toilet, office, indoor decoration or similar purposes...: other glassware: of lead crystal: valued over $5 each. The rate of duty will be 6 percent ad valorem. When there is a lead monoxide content less than 24 percent, the applicable subheading for the glass jar will be 7013.39.6000, HTS, which provides for glassware of a kind used for table (other than drinking glasses) or kitchen purposes other than that of glass-ceramics: other: other: other: valued over $5 each. The rate of duty will be 7.2 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
