The merchandise is described in your letter as an inverter. A sample was submitted. In a telephone conversation, Mr. David Schechter, Vice-President of Advance Watch Company, Ltd. stated that the device was a power inverter for use with electroluminescent safety vest and safety belts. The inverter contains a compartment for a 9V battery. The inverter converts the 9V DC to AC, which is needed to power the electroluminescent strips on the vests and belts. The applicable subheading for the inverter will be 8504.40.9570, Harmonized Tariff Schedule of the United States (HTS), which provides for "Inverters." The rate of duty will be 1.8 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
