Dear Mr. Santarelli: In your letter dated March 23, 1998, on behalf of Again Trading Corp., you requested a tariff classification ruling. The submitted samples are as follows: 1. Style #A-2083, consisting of a white translucent plastic barrette measuring approximately 3-1/2" x 1", attached to a metal spring clasp. 2. Style # A-2016, consisting of a white plastic barrette measuring 3" x 3/4", decorated with multi-colored flowers and happy faces, attached to a metal spring clasp. Your samples are being returned as requested. The applicable subheading for the barrettes will be 9615.11.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for combs, hair-slides and the like: of hard rubber or plastics: other: not set with imitation pearls or imitation gemstones. The rate of duty will be 5.3% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
