Dear Mr. Lichstein: In your letter dated February 10, 1998, you requested a tariff classification ruling. The submitted sample is a chair cover. It is made of denim fabric which is cut and sewn in the shape of an armchair. The cover has velcro strips and pockets and a zipper closure which allows for urethane foam and a plywood chair structure to be added to form the final product in the United States. When complete, the chair is an article of furniture designed to be placed on the floor or ground. Your sample is being returned as requested. The applicable subheading for the chair cover will be 9401.90.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for seats (other than those of heading 9402), whether or not convertible into beds, and parts thereof: parts: other: other. The rate of duty will be 0.8% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
