NY C83110 January 7, 1998 MAR-2-49:RR:NC:2:234 C83110 CATEGORY: MARKING Mr. Karl Krueger AEI-Carr Customs Brokerage Services 1600 West Lafayette Detroit, Michigan 48216 RE: The country of origin marking of periodical magazines, from Canada Dear Mr. Krueger: This is in response to your letter dated December 22, 1997, on behalf of your client, Interweb, Inc., requesting a ruling on whether the proposed marking "PRINTED IN CANADA", at the bottom of the publisher's masthead column on page 6 of each of two (2) periodical magazines is an acceptable country of origin marking for such imported articles. Marked samples were submitted with your letter for review, and will be retained for reference. The publications are: Natural Bodybuilding and Fitness, February, 1998 Vol. 11, No. 1; and Men's Exercise, The Fitness Guide for Today's Man, January 1998, Vol. 9, No. 1. Although you have not specifically so stated, we assume that country of origin marking of imported copies of these publications has not been considered by any Customs Service office. If in fact it has, this ruling may not be applicable. The marking of the samples reviewed is prima facie acceptable for merchandise of this class or kind, and satisfies the requirements of 19 U.S.C. 1304 and 19 C.F.R. Part 134. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 CFR Part 177). A copy of this ruling letter or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
