Box 3165 Harrisburg, PA 17105 RE: The tariff classification of a tree top pruner from Taiwan. Dear Ms. Aldinger: In your letter dated December 2, 1997, you requested a tariff classification ruling. The subject item, #4699644, is a tree top pruner with a handle. Its purpose is for pruning trees. This product features a high carbon steel hook and blade, fiberglass telescopic handle (which extends to 9 feet), a double pulley system, and a cutting capacity of 1 1/4". The item can be used for trimming or cutting tree tops. The applicable subheading for the tree top pruner will be 8201.60.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for hedge shears, two-handed pruning shears and similar two-handed shears, and parts thereof. The duty rate will be 1 cent each + 2.8% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
