Dear Ms. Baron: In your letter dated October 20, 1997, on behalf of Polo Ralph Lauren Corp., you requested a tariff classification ruling. Style number 27811 consists of two women's garments: a pullover and a camisole. The pullover is constructed from 100% silk, openwork, knit fabric and is to be worn over a 100% nylon, knit camisole. The pullover features a ribbed, pointed collar; a V-neckline and short cap sleeves. The camisole features 1/4 inch shoulder straps; a V-neckline and a hemmed bottom. Your samples are being returned as requested. The applicable subheading for style 27811, the pullover, will be 6110.90.1060, Harmonized Tariff Schedule of the United States (HTS), which provides for women's sweaters, pullovers...and similar articles, knitted: of other textile materials: containing 70% or more by weight of silk or silk waste: other. The duty rate will be 4.5% ad valorem. The applicable HTS subheading for style 27811, the camisole, will be 6109.90.1065, which provides for women's tank tops and singlets, knitted: of man-made fibers. The duty rate will be 33.4% ad valorem. The pullover falls within textile category designation 739. The camisole falls in category 639. Based upon international textile trade agreements products of Hong Kong are subject to quota restraints and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
