Box 3165 Harrisburg, PA 17105 RE: The tariff classification of a ceramic cup and saucer set from China. Dear Ms. Aldinger: In your letter dated October 1, 1997, you requested a tariff classification ruling. The sample submitted consists of a ceramic jumbo cup and saucer set of stoneware, item number 972210. The cup, which is valued at $.60 1/2 each, measures approximately 3 1/2 inches high with a top diameter of 5 inches and features a looped handle, while the saucer, which is valued at $.26 each, measures about 7 inches in diameter. The applicable subheading for the ceramic jumbo cup and saucer set, item number 972210, will be 6912.00.4500, HTS, which provides for other ceramic tableware...other than of porcelain or china: cups valued over $5.25 per dozen and saucers valued over $3 per dozen. The rate of duty will be 4.5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
