Dear Mr. Scharton: In your letter dated September 19, 1997, received in our office on September 24, 1997, you requested a classification ruling. Two samples, one a turban and the other a towel, were submitted for examination. The terry cloth turban is stated to be made of 80% polyester/20%nylon woven fabric. The item is placed on the head when hair is wet, twisted and closed with a button to form a turban. The antibacterial towel measures approximately 18 X 12 1/2 inches. The towel is stated to be made of woven 98% cotton/2% cravion fabric. The applicable subheading for the turban will be 6505.90.8090, Harmonized Tariff Schedule of the United States (HTS), which provides for Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Other: Of man-made fibers: Other: Not in part of braid, Other: Other. The duty rate will be 21 cents/kg + 7.6% ad valorem. The applicable subheading for the towel will be 6302.60.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for Bed linen, table linen, toilet linen and kitchen linen, of terry toweling or similar terry fabrics, of cotton, Towels: Other. The duty rate will be 9.9% ad valorem. The turban falls within textile category designation 659 and the towel 363. Based upon international textile trade agreements products of Japan are not subject to quota and the requirement of a visa at the present time. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
