Dear Mr. Coe: In your letter dated September 15, 1997, you requested a classification ruling. A sample wasn't provided but you indicate that the item to be imported is a silver plated chain necklace with two slides that contain cubic zirconia. Descriptive literature was submitted with your request. The applicable subheading for the necklace with slides that is valued not over $40.00 per piece will be 7116.20.0500, Harmonized Tariff Schedule of the United States (HTSUSA), which provides for articles of ...precious or semiprecious stones (natural, synthetic or reconstructed): articles of jewelry: valued not over $40 per piece. The duty rate will be 4.6% ad valorem. The applicable subheading for the necklace with slides that is valued over $40.00 per piece will be 7116.20.1500, HTSUSA, which provides for articles of...precious or semiprecious stones (natural, synthetic or reconstructed): articles of jewelry: other. The duty rate will be 6.5% ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations.
