The subject product, Atrazine Technical, is a selective herbicide having the following CAS chemical names: 6-chloro-N-ethyl-N'-(1-methylethyl)-1,3,5-triazine-2,4-diamine; 2-chloro-4-ethylamino-6-isopropylamine-s-triazine. The applicable subheading for Atrazine Technical, imported in bulk form, will be 2933.69.6020, Harmonized Tariff Schedule of the United States (HTS), which provides for: "Heterocyclic compounds with nitrogen hetero-atom(s) only: Compounds containing an unfused triazine ring (whether or not hydrogenated) in the structure: Other: Other: Pesticides." The rate of duty will be 3.5 percent ad valorem. This merchandise may be subject to the requirements of the Toxic Substances Control Act (TSCA), which is administered by the U.S. Environmental Protection Agency. You indicate in your letter that your client intends to ship certain materials from Germany to South Africa, where they will be used to formulate the finished product, i.e., Atrazine Technical, for export to the United States. Accordingly, you are also requesting a ruling on whether the operations carried out on the material imported into South Africa from Germany render the finished product a product of South Africa for purposes of the Generalized System of Preferences (GSP). For a ruling on this matter, you should write to the U.S. Customs Service, Office of Regulations and Rulings, 1300 Pennsylvania Avenue, NW, Washington, DC 20229. Please be advised that your request must include all the information required by Sections 10.176 through 10.178 of the Customs Regulations, in order for the Customs Service to issue a ruling. A copy of this ruling letter should also accompany your request. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
