Box 1491 Laredo, TX 78042-1491 RE: The tariff classification of five textured polyester yarns for use as the warp and filling yarns in woven and knitted fabrics, from China. Dear Mr. Munoz: In your letter dated August 29, 1997, on behalf of Xianglu Fibers (Xiamen), Haicang, Xiament, China, (the manufacturer), you requested a classification ruling. Five representative samples were submitted which were identified on their respective spools as 167/36 SY, 168/48 NSNY, 167/96 SISY, 333/72 SY, and 333/72 NSWY. The first number appears to refer to the denier and the second number applies to the number of filaments. All five yarns are constructed from multi-filament textured polyester man-made fibers (synthetic) which are not put up for retail sale. These are all single yarns which will be manufactured into various knitted and woven fabrics after their importation into the United States. The applicable subheading for the five yarns will be 5402.33.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for synthetic filament yarn (other than sewing thread), not put up for retail sale, including synthetic monofilament of less than 67 decitex, ..., textured yarn, of polyesters, single yarn. The duty rate will be 9.6 percent ad valorem. This merchandise falls within textile category designation 600. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
