The submitted sample, style #101 is a ladies visor that consists of a plastic frame covered with textile material. The upper part of the frame is covered with knit fabric that is stated to be 50-50 poly-metallized yarn with the bottom part of the frame covered with knit fabric that is stated to be 50% nylon, 32% polyester and 18% cotton. Examination revealed that the gold metallic finish to the upper knit fabric has been applied by a coating or painting process and not by knitting together polyester and metalilized yarns. We assume that this upper knit fabric is made up of man-made fibers.

Dear Mr. Plenby: In your letter dated August 15, 1997, on behalf of Avon you requested a classification ruling. A sample was submitted for examination and will be returned as requested. The submitted sample, style #101 is a ladies visor that consists of a plastic frame covered with textile material. The upper part of the frame is covered with knit fabric that is stated to be 50-50 poly-metallized yarn with the bottom part of the frame covered with knit fabric that is stated to be 50% nylon, 32% polyester and 18% cotton. Examination revealed that the gold metallic finish to the upper knit fabric has been applied by a coating or painting process and not by knitting together polyester and metalilized yarns. We assume that this upper knit fabric is made up of man-made fibers. The rate of duty will be 33.8 cents per kilogram plus 12 percent ad valorem. Style #101 falls within textile category designation 659. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
