Dear Ms. Aldinger: In your letter dated June 13, 1997, received in this office on July 15, 1997, you requested a tariff classification ruling. The submitted sample is a 4-piece acrylic bagel storage set, item #972230. This item consists of a circular, eleven inch cylinder storage container with an acrylic stacking pole and a wooden lid. Also included is an acrylic bagel slicing holder and knife. The slicing knife has a plastic handle. Item #972230 is not a set for tariff purposes. The applicable subheading for the acrylic storage container and the bagel holder will be 3924.10.5000, Harmonized Tariff Schedule of the United States (HTS), which provides for tableware, kitchenware, other household articles...of plastics: tableware and kitchenware: other. The rate of duty will be 3.4 percent ad valorem. The applicable subheading for the knife will be 8211.92.2000, HTS, which provides for knives with cutting blades, serrated or not (including pruning knives), other than knives of heading 8208, and blades and other base metal parts thereof: other, other knives having fixed blades: with rubber or plastic handles: kitchen and butcher knives. The rate of duty will be 0.9 cents each plus 5 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
