Dear Ms. Smith: In your letter dated 6/17/97 you requested a tariff classification ruling. Number 91007 is an assortment of snowman figurines ranging in height from 4" to 5", #91021 an assortment of moose figurines, #91024 an assortment of snowmen ranging in height from 8" to 8.5", #97891 an assortment of wood look carved angels 7" in height and #97896 an assortment of gold foil finished angel figurines. A sample of #97891 was provided. In your letter you explain that these articles are made of 50% polyester resin and 50% calcium carbonate which is derived from natural marble stone. Both ingredients are evenly distributed throughout the body of the articles. The applicable subheading for the figurines will be 6810.99.00, Harmonized Tariff Schedule of the United States (HTS), which provides for "Articles of cement, of concrete or of artificial stone...:Other articles: Other". The rate of duty will be 2%. We note that the sample you provided is marked "Made In Taiwan" on an adhesive label. Please insure that importations are marked with the correct country of origin prior to shipment. Your sample is returned herewith. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
