Inasmuch as the outer shells of both items are constructed completely or predominantly of neoprene rubber sheet which has been laminated to nylon knit fabric on both of its surfaces, both items have outer surfaces of man-made fibers. In addition the style EX002 fanny pack has an outer surface partially constructed from a woven nylon fabric (the bottom and back of the item). The fanny pack also has a zip around closure at its top, a zippered exterior pocket on the side which faces the user's body, and an adjustable textile webbing belt having a plastic slider with bayonet clip buckle. The water bottle carrier (style EX003) is similar to a holster and has an adjustable textile webbing shoulder strap also having a plastic slider with bayonet clip buckle. The shoulder strap is looped through the bottom of the carrier and is stitched to each side near the open top.

The items which GoNeo intends to import are a fanny pack (style EX002 "H20 Extreme Fanny Pack") and a water bottle carrier (style EX003 "H20 Extreme Water Bottle Tote"). The applicable subheading for the water bottle carrier will be 4202.92.9025, Harmonized Tariff Schedule of the United States (HTS), which provides for other bags and containers, with outer surface of textile materials, other, other, other, of man-made fibers. The rate of duty for this item will also be 19.3 percent ad valorem. Items 4202.92.3030 and 4202.92.9025 fall within textile category designation 670. Based upon international textile trade agreements, products of China, Korea, and Taiwan are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). The samples are being returned herewith in accordance with your request.
