Dear Ms. Franklin: In your letter dated January 31, 1997, you requested a tariff classification ruling. The sample submitted with your request, no style number, is a cooler bag approximately 15" x 11" x 5". The bag has a webbed textile adjustable shoulder strap, an undivided interior compartment and an outside pocket. Both the main compartment and outside pocket have top zipper closures. The interior is constructed of high density insulating foam with low toxic/temp lining. The outer surface is 100% PVC sheeting (600 Denier Pattern) with polyester backing. This item is specifically designed and constructed, by material, to maintain a cold temperature for food or beverage. The applicable subheading for the cooler bag will be 4202.92.9060, Harmonized Tariff Schedule of the United States (HTS), which provides for trunks, suitcases...etc., other, with outer surface of sheeting of plastic, other. The rate of duty will be 19.3 per cent ad valorem. The bag is being returned as requested. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). A copy of this ruling letter should be attached to the entry documents filed at the time this merchandise is imported. If the documents have been filed without a copy, this ruling should be brought to the attention of the Customs Officer handling the transaction. Sincerely, Richard A.
