Dear Ms. Hansen: In your letter dated October 1, 1996, you requested a tariff classification ruling. The submitted sample is a necklace with a pouch, part number AY707. The necklace consists of a polished cowry shell, natural black coffee beads, two blue glass Indian beads and two red glass Indian beads that are strung on a thin leather thong. It measures 16" in length from end to end and has an antique brass clasp. The necklace is made primarily of natural substances so each necklace will have unique characteristics of its own such as shell size and color variation of coffee beads. The necklace pouch is African fabric, 100% cotton, and has a thin leather drawstring at the opening. The pouch is unlined and measures approximately 3¬" x 3¬". The applicable subheading for the cowry shell necklace will be 7117.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for imitation jewelry: other: other: valued over 20 cents per dozen pieces or parts: other: other. The rate of duty will be 11% ad valorem. Articles classifiable under subheading 7117.90.9000, HTS, which are products of Kenya are entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The applicable subheading for the pouch will be 4202.32.4000, HTS, which provides for articles of a kind normally carried in the pocket or in the handbag: with outer surface of textile materials: of vegetable fibers and not of pile or tufted construction: of cotton. The rate of duty will be 7% ad valorem. Item 4202.32.4000 falls within textile category designation 369. Based upon international textile trade agreements products of Kenya are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected. Part categories are the result of international bilateral agreements which are subject to frequent renegotiations and changes. To obtain the most current information available, we suggest that you check, close to the time of shipment, the Status Report on Current Import Quotas (Restraint Levels), an internal issuance of the U.S. Customs Service, which is available for inspection at your local Customs office. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
