Dear Mr. Fischer: In your letter dated August 2, 1996, on behalf of Paulith U.S.A., Inc., you requested a tariff classification ruling. All the materials, per the representative samples submitted, consist of textile fabrics coated on one surface with textile flock. They are all constructed and finished to create such surface effects ranging from velvet, corduroy and pile to imitation leather and suede. While no specifics were provided, including the possible end use of these materials, your letter made reference to the following articles numbers: 2002, 2003, 206, 4841, 4842, 506, 515, 660, 7841 and 804. The classification of these materials is predicated upon the composition of the base fabrics only. You have both woven and knit base fabric constructions and the fiber content of these base fabrics were not identified. If the woven or knit base materials are of man-made fibers, the applicable subheading for the product will be 5907.00.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for textile fabrics otherwise impregnated, coated or covered, ... not laminated, of man-made fibers. The rate of duty will be 4.6 percent ad valorem. If the woven or knit base materials are of cotton, the applicable subheading is 5907.00.8090, HTS, which provides for textile fabrics otherwise impregnated, coated or covered, ... not laminated, of cotton. The duty rate is 4.6 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177). In the future, please limit your ruling requests to no more than five samples. A copy of the ruling or the control number indicated above should be provided with the entry documents filed at the time this merchandise is imported.
