Candles shaped in the form of identifiable objects (Santa Claus, Ghost) are not within the scope of the Anti Dumping Duty order.

The prospective imports are as follows: 1) One Red Santa Claus with a toys bag molded into a candle measuring approximately 4 inches in length and 3 1/2 inches in diameter. 2) One Green Santa Claus with a Christmas Tree molded into a candle measuring approximately 6 inches in length and 2 1/4 inches in diameter. 3) One White Ghost with an embossed pumpkin molded into a candle measuring approximately 5 1/2 inches in length and 3 inches in diameter. 4) One 42 inches Pumpkin Windstock consisting of a 100 percent nylon. The rate of duty will be 3.5 percent ad valorem. The rate of duty will be 7 percent ad valorem. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
