Dear Mr. Sheridan: In your letter dated March 11, 1996 you requested a classification ruling. The submitted sample is a plain woven bleached fabric. Laboratory analysis indicates that this product is composed of 64.9% staple polyester and 35.1% cotton. It contains 48 single yarns per centimeter in the warp and 29.9 single yarns per centimeter in the filling. This fabric is constructed using 45/1 c.c. yarns in both the warp and the filling. Weighing 108.9 g/m2, this item will be imported in 150 centimeter widths. Based on the information developed by the laboratory, the average yarn number for this fabric has been calculated to be 72 in the metric system. The applicable subheading for the bleached plain woven fabric will be 5513.11.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for woven fabrics of synthetic staple fibers, containing less than 85 percent by weight of such fibers, mixed mainly or solely with cotton, of a weight not exceeding 170 g/m2, unbleached or bleached, of polyester staple fibers, plain weave, poplin or broadcloth. The duty rate will be 16.6 percent ad valorem. This fabric falls within textile category designation 614. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa. The designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected.
